Case of the Week – 9/18/11 – Berns v. Doan

Megan Berns was driving her daughter Kylee to a dance recital at a local church when she came upon a fallen tree blocking the road. She pulled into Debra Doan’s driveway to turn around. Mrs Doan was backing out of her garage and hit the Bern’s car. The Delaware Supreme Court decides if Mrs Doan can be liable for her negligent operation of a motor vehicle or if the Bern’s claim is barred because they were trespassing when they were hit. Berns v.
