Case of the Week – 7/17/11 – USA v. Monson

The Sheriffs lied in a search warrant affidavit and searched Dejay Monson’s home. They found guns and pot. The search was thrown out by the Court because of the lies in the affidavit. The Eight Circuit Federal Court Of Appeals decides if Monson can get his legal fees paid by the Government because the prosecution was “vexatious, frivolous or in bad faith”. USA v Monson
